"Can I monetize this?" is the first question most creators ask about AI voices. For ElevenLabs the short answer is: yes on a paid plan, no on the Free plan, as long as you follow the Prohibited Use Policy and have the rights to what you feed in. Here are the details, straight from the official pages.

Sources: ElevenLabs Terms of Service (non-EEA, last updated October 9, 2026) and elevenlabs.io/pricing, both checked October 27, 2026. Users in the EEA, Switzerland or UK have a separate version of the Terms.

Rule 1: Free = non-commercial, paid = commercial

Section 1(c) of the Terms says that if you use the Services free of charge you "may only use the Services for non-commercial purposes", and if you use a paid subscription you "may use the Services for commercial purposes", in both cases subject to the Prohibited Use Policy. The pricing page matches: Commercial License is listed starting at Starter ($6/month).

Rule 2: You keep rights in your output

Section 4(c) says that, as between you and ElevenLabs, you retain all rights in your Input and Output (the models themselves stay ElevenLabs'). But section 4(d) also grants ElevenLabs a broad license to use your content to provide and improve the Services. You can opt out of training use in your account's data-use settings, per section 4(i).

The Terms also note that because of how AI works, output may not be unique: another user could get the same or similar audio.

Rule 3: You need the rights to your input

You can't upload scripts or voice recordings you don't have rights to (section 4(g)). For cloning, a User Voice Model must be your voice or a voice you're authorized to share (section 4(b)). Don't clone celebrities, clients or friends without permission.

Rule 4: The Prohibited Use Policy always applies

Even on paid plans, all use must comply with ElevenLabs' Prohibited Use Policy. Voice Library voices also have their own addendum, and Supplemental Terms win if they conflict with the main Terms.

  • Upgrade before you publish monetized content, not after.
  • Keep a record of your plan and the date you generated commercial assets.
  • Disclose AI narration where platforms require it.
  • For high-stakes projects (broadcast ads, big clients), check the current Terms or ask ElevenLabs directly.

+

No. The ElevenLabs Terms of Service say Free users may only use the Services for non-commercial purposes. The pricing page lists the Commercial License starting on the Starter plan ($6/month).

Who owns the audio I generate with ElevenLabs?

+

The Terms say that, as between you and ElevenLabs, you retain all rights in your Input and Output (excluding ElevenLabs' models), subject to the Terms and a license you grant ElevenLabs to use your content to provide and improve the Services.

If I cancel my paid plan, can I still use audio I made commercially?

The Terms tie commercial use to being a paid user and say you retain rights in your Output, but they don't spell out this scenario in a single sentence. If it matters for your business, contact ElevenLabs or get legal advice.

Can I clone someone else's voice for commercial use?

Only with authorization. The Terms say a User Voice Model must be your voice or a voice you are authorized to share, and you may not provide input you don't have the rights to.
